Terms of Service

1. Acceptance of terms
By creating an account or using ViralGen ("the Service", "we"), you accept these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Use of artificial intelligence
ViralGen uses artificial intelligence (including Anthropic Claude models, ElevenLabs for voice narration, and image-generation models via Vercel AI Gateway) to generate ideas, titles, scripts, thumbnails, narration, and video from your input and public YouTube data. AI-generated content may contain errors, inaccuracies, or unintentional similarities to existing works. You are responsible for reviewing and editing any generated content before publishing it.
3. Your account
You are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
4. Subscriptions and credits
Access to Service features is governed by a subscription plan and credit system, detailed on our pricing page. Charges are non-refundable except where applicable law requires otherwise. We reserve the right to change prices and plans with reasonable prior notice.
5. Content you upload or generate
You retain ownership of content you upload (scripts, reference images, audio) and of content you generate using the Service, subject to the license terms of the underlying AI providers. You grant us a limited license to process, store, and display that content solely to operate the Service for you.
You are solely responsible for ensuring content you upload does not infringe copyright, trademark, publicity rights, or any applicable law, and that generated content you publish complies with the policies of the platform where you publish it (YouTube or others).
6. Copyright policy (DMCA)
We respect the intellectual property rights of others. If you believe content hosted on ViralGen infringes your copyright, send a notice to our designated agent with:
- Identification of the protected work and the infringing material.
- Your contact information (name, address, phone, email).
- A good-faith statement that the use is unauthorized.
- A statement, under penalty of perjury, that the information is accurate.
- Your physical or electronic signature.

Upon a valid notice, we will remove or disable access to the flagged content and, where applicable, notify the uploader, who may submit a counter-notice under applicable law. Repeat infringers may be removed from the Service.
7. Limitation of liability
The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages arising from use of the Service, including lost revenue from AI-generated content.
8. Dispute resolution and arbitration
You and ViralGen agree to resolve any dispute arising from these Terms through binding, individual arbitration, instead of going to court, except for claims that qualify for small-claims court. You waive your right to participate in a class action or class arbitration. Arbitration will be conducted confidentially before a neutral arbitrator, under the commercial arbitration rules in effect in your jurisdiction of residence.
9. Termination
We may suspend or cancel your account if you violate these Terms. You can cancel your subscription at any time from your account panel.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service. Continued use after changes take effect constitutes acceptance.
